1. Acceptance of Terms
By creating an account or using Pharmly, you agree to these Terms of Use. If you do not agree, please do not use the service.
2. Eligibility
You must be able to form a legally binding contract to use Pharmly. Pharmacy accounts must be registered businesses holding a valid Ghana Pharmacy Council registration. Wholesaler accounts must be registered businesses holding a valid FDA Wholesale Dealer Licence, RGD certificate, TIN and VAT registration, verified during onboarding.
3. Account Registration
You're responsible for keeping your phone number and account credentials secure. You agree to provide accurate information during signup and to keep your profile up to date.
4. Reservations & Orders
Reservations hold medication at a pharmacy for a limited time (typically 48 hours) and are paid in person. Online orders are paid in advance via Paystack, may be fulfilled by delivery or pickup depending on the pharmacy, and may require a verified prescription — in which case the order is held for the pharmacy's review before payment is requested. Pharmacies may cancel a reservation or order if stock becomes unavailable.
5. Wholesale Ordering
Verified pharmacies may place restock orders with wholesalers through the Restock feature; this is not available to patients. Wholesalers may set a minimum order quantity (MOQ) per product that pharmacies must meet when ordering. Restock orders are invoiced directly between the pharmacy and wholesaler — Pharmly does not process payment for these orders.
6. Payments & Fees
Pharmacy subscription fees and platform service fees are billed as described on the Pricing page. Outstanding service fees beyond ₵500 may result in catalogue additions being paused until settled. Online order payments are processed via Paystack, which splits each payment at the point of sale — sending the pharmacy's share to its linked payout subaccount and Pharmly's service fee to us. Pharmacies are responsible for keeping their payout details accurate; all online payments are otherwise processed by Paystack under their own terms.
7. Pharmacy & Wholesaler Responsibilities
Pharmacies are responsible for the accuracy of their catalogue, pricing, and stock levels, and for verifying prescriptions before dispensing prescription-only medication. Wholesalers are responsible for the accuracy of their catalogue, pricing, MOQs, and the validity of the licence documents submitted during onboarding.
8. Prohibited Use
You may not use Pharmly to list or order controlled substances outside applicable law, misrepresent your identity or business credentials, or interfere with the platform's normal operation.
9. Limitation of Liability
Pharmly facilitates connections between patients, pharmacies, and wholesalers but is not itself a pharmacy or wholesale dealer. We are not liable for the quality, safety, or legality of medication dispensed or supplied by listed pharmacies and wholesalers.
10. Termination
We may suspend or terminate accounts that violate these terms, including pharmacies or wholesalers with persistent unpaid fees or fraudulent activity.
11. Governing Law
These terms are governed by the laws of the Republic of Ghana.
